My mother is studying in University to become a Social Worker. This is a job she has wanted to do pretty much her whole life. She has been working in the caring profession for as long as I can remember, and loves every single day of it. She has poured her heart and soul into this, the whole time she’s been in University she’s been working nights just to put food on the table.

But now she’s been told she can no longer study in University. Why? Because British Legislation in the Scotland has stopped her. My mother is adopted into her respective family, she had a very rough childhood, she was in and out of homes, she grew up on the streets, got into trouble a lot with the police. One of the stories I can tell you, is when she was in a home when she was 15, she watched a group of girls light another girl on fire when she was asleep in bed. She’s came out on top of everything for the bastards to turn her down.

When one turns 40, everything from their past gets wiped, therefore you do not need to disclose any past crimes. So when asked about any infringement of the law, my mother obviously ticked none, because she hadn’t anything to disclose.

When my mum was 12, she called someone up, and was ‘abusive’ to them over the phone. Under new legislation, this is considered a sexual crime, and must be disclosed. My mother had no idea she even done it! So because of all of this, she has been told there is a high probability she will be forced out of University, and possibly out of her job as a care taker in Elderly Homes. She has a meeting with her Law professor (Tommy Sheridan’s sister), to find out what can be done about it. But right now I’m looking for any loop holes in the legislation, or any ideas about what can be done. My mum doesn’t know if she wants to fight it. It means taking on Westminster, and even in the chance she does win, then she ahs to repeat all the hard work she ahs put into University, and she doesn’t think she’s up for it.

I’m fuming at the fact a foreign legislation is stopping a women, who’s the potential to be one of the great social workers in the west of Scotland, from doing what she loves. My mother has the experience of what life is like for the people she would work with, compared to all the posh twats who just think they know.

So any advice?

So what you are saying is that the authorities bar her from becoming social worker because of her life situation she had to endure in her childhood? That is something unbelievable.

I have really no idea, since my knowledge about the UK legislation and procedures (having never lived there or been there) is tantamount to zero. Maybe some people from Stripes who live in the UK could give some useful advice.

In any case she should continue her battle if becoming social worker is something she really wants and loves.

No problem. I believe the elgislation can be found on the net though, so i'm sure you could find it if you're interested in finding it.

Yes. She is going to try, but I feel she wont be able to cope with it.

People convicted for crime done as children by applying a retroactive legislation, and being kicked out of university?

It's not like we want it this way either, I feel for you. It's the stupidest thing I've heard a law do for .. well, a really long time.

... but please don't blame England when we didn't do anything. It was the stupid, effed up union.

My mother has been a social worker for 35 years... Even though she has had a different experience (growing up poor, leaving school early, eventually going to college many years after she left school and after she was married to my dad to be a social worker), I think (despite being one of the "evil", "oppressive" English), she would have the same problem if there was some sort of record like this too on her.

I think that your mum could easily fight this against the university as it is really a ridiculous charge and any reasonable university board/whatever organisation it is in Scottish unis would allow her to stay. She is after all paying some sort of fees, right? She could take it up with students' union (well I know all Canadian students are unionised... pretty sure the same in UK) also who may help her out also.

edit: Though I think the word "apartheid" in the article is a little strong... ,-,

British legistlation with an English majority voting for it? It is completely different for England. It's a two way street though, Scots shouldn't be voting on English Issues. Sorry if I have came across as a little Anti-English, but when my mothers heart si broken and shes in tears, i'll tend to get a little pissed off.

I talked to my mother about this.

After explaining the situation to her, she said there was no reason for the univeristy to kick her out and that it would be easily overturned if there was a decision made against your mother.
