Court charges Ecuatorians with gang raping Spanish underage girl

Two "Latin Kings" condemned to serve 10 and 12 years in prison for a gang rape on an underage girl

Madrid's Court has condemned the members of the gang known as "Latin Kings", Walter Patricio Y.T. and Pablo Efraín V.E., known as "King Pinky" to serve 10 and 12 years in prison respectively, for taking part in the gang rape of a Spanish underage girl in the town of Collado-Villalba on December 6, 2005.

The court has acquitted Giovanny José C.V., known as "King Cano", of the 6 crimes for sexual aggresion for which he had been accused. He was an accused party in the trial against other 14 suspected bosses of this Latino gang that took place recently.

In a sentence made public today, the court condemns Walter Patricio Y.T. and Pablo Efraín V.E., both from Ecuador, as the responsible authors of a continued crime of rape for which they will have to pay 120,000 euros between the two of them to the victim as a compensation for the moral damages derived from the rape. The gang rape was carried out by six people, three of which had not been identified. As a result, the young girl got pregnant, but she aborted.

The evidence presented by the court resolution reads that on december 6th in 2005, Giovanny José C.V. made a phone call to the 17 year old girl, to organize a date with her at 6 pm in the coach station of Collado-Villalba. Walter Patricio Y.T. picked her up there, while she expected Giovanny.

He took her to the to the backside of the María Guerrero Institute. Short after came Pablo Efraín V.E. together with Mauricio Alexander C.P., under the legal age, and other four youths who have not been identified. Then they abused her sexually one after the other, while Walter Patricio Y.T. observed a few meters back.

According to the sentence, "while the girls was sexually raped by Pablo, Mauricia was holding her arms and one of the unidentified rapers her legs", and the girl started crying while she tried to defend herself with a cigarrette.

Mauricio Alexander C.P., who admitted that Pablo Efraín raped the girl, will be judged by the juristiction for underaged, while the other aggresors have not been identified because they were hiding their faces with hats and women underwear.

The court justifies the acquital of Giovanny José C.V. in that his part in the gang rape "is not clear" and, thereafter, "we must apply the principle in dubio pro reo". Although the girl pointed him as one of the people who raped her, the court sentenced that it could have been his presence in the trial that determined the accusation.

The resolution reads that "the fact that Giovanny had made the phone call to the girl in the morning does not allow use to assure that he took part in the events". Giovanny said that he rang her up but then he gave his mobile phone to Walter and Pablo.
